Terms of Service

Effective date: 4 September 2026

These terms are the agreement between you and the people behind luna. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use the App.

1. Acceptance of Terms

By downloading or using luna, you confirm that:

• you are at least 13 years old – and, if you are in the EU, that you have a parent or guardian's consent if you are under 16;
• you accept these Terms and our Privacy Policy;
• the information you provide is your own, and you will use luna in line with these Terms and applicable law.

2. Service Description

luna is a sleep journal for personal reflection. You log when you went to bed and when you woke, and luna reflects your rhythm back to you. It also offers an optional Sleep Buddy: a private, one-to-one pairing where you can send goodnight taps, bedtime guesses ("Peek"), a curiosity nudge ("Night nudge"), short voice notes ("Night letter"), and recorded answers to shared questions ("Time Capsule"). With your permission, luna can also read bedtime and wake-up times from Apple Health and write the nights you log back to it; both are optional and off until you switch them on (see the Privacy Policy).

luna is not a medical device. It does not diagnose, treat, monitor, or prevent any condition, and it does not measure sleep "quality", sleep stages, or anything a medical sleep study would – on purpose. Nothing in luna is medical advice.

3. Account and Security

3.1 No Account Needed

luna needs no login, email, or password to use. Your journal lives on your device and in your own iCloud (see the Privacy Policy), and you are identified only through your Apple ID. You are responsible for maintaining the security and confidentiality of the Apple device and Apple ID through which you use luna.

3.2 Your Responsibility

You are solely responsible for all activity that occurs through your device and Apple ID. If you believe your Apple ID or device has been compromised, secure it with Apple right away and notify us of anything that affects your luna data.

3.3 Sleep Buddy Connection

You can connect with one buddy at a time, by exchanging six-character luna codes. Both of you must consent to connect, and either of you can end the pact at any time, which stops all sharing and blocks further contact.

4. Purchases and Payment

4.1 Plan

luna is unlocked with a yearly subscription, which includes all features, the Sleep Buddy included. The current price is shown in the App Store before you confirm, in your local currency, and may differ by region. Any promotional or introductory offer is shown there as well, together with the price that applies once it ends.

4.2 Billing

Payment is charged to your Apple Account through the App Store when you confirm the purchase. Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current period; you manage and cancel your subscription in your Apple Account settings.

4.3 Refunds

Refunds are handled through the Apple App Store in accordance with their refund policies. We cannot cancel or refund on Apple's behalf.

5. User Content and Conduct

5.1 Your Content

You retain ownership of all content you create or share in the App, including your journal and the notes and recordings you send a buddy. By using the App, you grant us a license to store and display your content as necessary to provide the service.

5.2 Prohibited Conduct

You agree not to:

• use luna for any illegal purpose or in violation of any law;
• send content that is harassing, abusive, offensive, or harmful to your buddy;
• harass, abuse, harm, or impersonate another person;
• attempt to access another person's data or account;
• reverse-engineer, decompile, disrupt, or interfere with the proper functioning of the App;
• upload viruses or malicious code.

5.3 Content Guidelines

You are solely responsible for the content you share with your buddy. We do not monitor content shared between buddies, but we reserve the right to remove content or end connections that violate these Terms. If your buddy sends you content that violates these Terms, report it to hello@lunasleepjournal.com – and remember you can end the pact yourself at any time, which stops all contact.

6. Intellectual Property

6.1 Our Rights

The App, including its design, features, code, and content (excluding user-generated content), is owned by luna and is protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a personal, non-exclusive, non-transferable licence to use luna for your own private, non-commercial use.

7. Termination

7.1 By You

You can delete your data at any time through the App's settings. Deleting it permanently removes your journal and buddy data from your device, your own private iCloud, and the buddy directory.

7.2 By Us

We reserve the right to suspend or end your access at any time if:

• you violate these Terms;
• your use of the App poses a security risk; or
• we discontinue the App.

7.3 Effect of Termination

Upon termination, your right to use the App will cease immediately. All provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

8. Disclaimers and Limitation of Liability

8.1 "As Is" Service

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, secure, or error-free.

8.2 Not Medical Advice

luna is not a substitute for professional medical or sleep advice, diagnosis, or treatment. If you have concerns about your sleep or health, please speak to a qualified professional. You rely on luna's figures at your own discretion.

8.3 Limitation of Liability

To the maximum extent permitted by law, luna shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• your use or inability to use the App;
• any unauthorized access to or use of your device, iCloud, or personal information;
• any interruption or cessation of transmission to or from the App;
• any bugs, viruses, or other harmful code transmitted through the App;
• any errors or omissions in the content;
• any conduct of other users.

Nothing in these Terms limits liability that cannot be limited by law, such as for death, personal injury, or intent or gross negligence where applicable.

9. Indemnification

You agree to indemnify and hold harmless luna and its affiliates, officers, agents, and employees from any claim, demand, loss, or damage, including reasonable attorney's fees, arising out of or related to:

• your use of the App;
• your violation of these Terms;
• your violation of any rights of another person or entity;
• content you share in the App.

10. Changes to the App and Terms

10.1 Changes to the App

We reserve the right to modify, suspend, or discontinue any feature of the App at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

10.2 Changes to the Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms in the App and updating the "Effective date" above. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

11. General Provisions

11.1 Governing Law

These Terms are governed by the laws of Switzerland, without regard to its conflict-of-law rules, and subject to any mandatory consumer protections of your country of residence.

11.2 Dispute Resolution

Any dispute that cannot be resolved amicably shall be subject to the ordinary courts of Switzerland, unless mandatory law grants you the right to bring a claim where you live.

11.3 Severability

If any provision of these Terms is found unenforceable, it will be limited or removed to the minimum extent necessary, and the rest will remain in full force.

11.4 Entire Agreement

These Terms, together with our Privacy Policy, are the entire agreement between you and luna regarding the App, and supersede any prior understandings.

11.5 Apple

luna is licensed, not sold, to you, and your use is also subject to Apple's Licensed Application End User License Agreement. Apple is not responsible for luna or its content, and Apple is a third-party beneficiary of these Terms and may enforce them.
